š What is Temporary Protected Status (TPS)?
TPS is a humanitarian measure that allows individuals from certain countries to temporarily remain in the United States when their home country cannot guarantee their safe return. This protection is generally granted in response to:
Prolonged armed conflicts āļø
Natural disasters such as hurricanes, earthquakes, or epidemics šŖļøš
Other extraordinary conditions that prevent normal life in their country š
Once approved, TPS allows the beneficiary to: ā Remain legally in the U.S. ā Apply for an employment authorization document (EAD) š§¾ ā Obtain permission to travel under certain conditions āļø
š¢ 2025 Update:
}TPS Extension for South Sudan The Department of Homeland Security (DHS) announced an automatic extension of TPS for South Sudan for a period of six months, covering from May 4, 2025, to November 3, 2025. This measure seeks to protect thousands of people given the unstable situation in the African country.
š Key Points: š
You do not need to re-register.Ā If you already had valid TPS, your protection is automatically extended without needing to submit a new application. š Your employment authorization document (EAD) is also extended.Ā EADs with an expiration date of November 3, 2023, or May 3, 2025, are considered valid until November 3, 2025, provided you remain eligible for TPS. š Do you need a new EAD with the new date?Ā You can file Form I-765 to obtain an employment authorization card with the updated date. You can also request a fee waiver if your financial situation qualifies. š Don't worry if your application is still pending.Ā If you submitted a TPS or EAD application before May 6, 2025, and it is still in process, you do not need to resubmit anything. If your application is approved, you will automatically receive the extended benefits.
š” What should I do now?
Although this extension is automatic, it's important to take precautions to protect your immigration status: ā Make sure to keep a copy of the official USCIS announcement and the extension published in the Federal Register. ā If your employer requests proof of your work authorization, you can show your EAD along with a copy of the extension notice. ā Consider exploring other permanent immigration options with the support of an attorney if you wish to settle long-term in the U.S.
š¤ What will happen after November 3, 2025?
As the expiration date approaches, the U.S. government will evaluate whether TPS for South Sudan should be:
Renewed again š
Modified š
Or terminated š«
It is crucial to stay informed and prepared for any possible changes. In many cases, TPS beneficiaries may qualify for other options such as: š¹ Family petitions based on relationships with citizens or permanent residents š¹ Adjustment of status if they entered legally š¹ Humanitarian or asylum applications, depending on the circumstances
